Registered mortgages, charges, and other dealings — and a clear statement of what an encumbrance certificate does not prove.
An encumbrance certificate is a search of registered transactions for a stated period at the office that issued it. Buyers are often handed a “nil” certificate and told the property is free. The word “nil” only means that office did not find a registered dealing in that window.
We read the certificate against the chain of title, ask whether the period is long enough, and look for loans, charges, and security interests that the certificate may not mention.
Laws and records vary by state. Khata, mutation, jamabandi, patta, and municipal extracts are not interchangeable, and the office that holds them changes with the city. The points below describe the work in general. The papers we ask for follow the property’s location, and the report names the source that was actually consulted.
Tell us the city and what you are buying. We will reply with the papers to send and a quote for the scope.
